Welcome Garibaldi! (Great famous name there.)

Congrats on your first post. You might want to spend some time in the COMPANIES (http://www.warofrightsforum.com/forumdisplay.php?22-Companies) area of the forums. These are divided into USA and CSA, and at the top of each one you will find a stickie post entitled ORDERS of BATTLE.
THIS is the Union order of Battle (http://www.warofrightsforum.com/showthread.php?1385-Union-Order-of-Battle-Company-Overview) and with a bit of looking you'll find that the 39th NY is listed as an active regiment as part of the Harpers Ferry Garrison.
THIS is the Confederate order of Battle (http://www.warofrightsforum.com/showthread.php?1386-Confederate-Order-of-Battle-Company-Overview) and again, with a bit of looking, you'll find that the 10th LA is listed. It is a member of Starke's Brigade of Jackson's Division.

Also of note, on these two Orders of Battle, if you scroll all the way toward the bottom, you'll find an area that says, "Units formed that are unassociated with Antietam". What this means is no one is limited in forming any regiment they desire, however in the quest for realism, separation of units in this fashion is understandable.

Your English is Fine. Much better than my Italian, (non-existent, even after 4 years of Spanish 1)
